Arbitration in Ibero-America

CMS has a well-established and leading arbitration practice in Ibero-America, recognised for its strategic approach, its ability to handle complex disputes and its strong international coordination. We support our clients in both domestic and international arbitration proceedings, as well as in investor–State disputes, combining deep local knowledge with the global reach of CMS. In Ibero-America, CMS has the Ibero-American Arbitration Group (GIA), which brings together specialised teams in Brazil, Chile, Colombia, Spain, Mexico, Peru and Portugal, supported by the international CMS network. This structure enables us to provide advice aligned with the legal, regulatory and sector-specific realities of each country, while maintaining a consistent overall strategy.

Our team advises at all stages of arbitration: from drafting and negotiating arbitration agreements to conducting arbitration proceedings, representing clients before national courts in support of arbitration, and the recognition and enforcement of awards. We act both as counsel and arbitrators, which allows us to offer a comprehensive and practical perspective on each dispute. 

Our arbitration practice is distinguished by its strong sector focus. We regularly advise on disputes related to M&A, energy, infrastructure, construction and engineering, financial services and banking, insurance, telecommunications, technology, healthcare and life sciences, real estate and tourism, among others. This specialisation enables us to understand not only the applicable legal framework but also the operational and strategic challenges of each industry.
We also have extensive experience in investment arbitration and investor–State disputes, advising both companies and public entities in proceedings involving significant technical complexity and economic relevance.
