Bruno Cação Ribeiro, attorney at FAS Advogados in cooperation with CMS, analyses, in an article published by Portal PANROTAS, the new emergency credit facility approved by the National Monetary Council for Brazilian airlines.

The measure reignites the debate on the role of the State in civil aviation and its legal, competitive and regulatory impacts. Although it was created in response to liquidity challenges, rising operating costs, exchange-rate volatility and pressure on the sector, the initiative also raises relevant issues concerning competitive neutrality, governance, eligibility criteria and the limits of State intervention.

For companies operating in the aviation, tourism, hospitality, logistics, infrastructure and related services sectors, the matter requires strategic attention. The expansion of public financing instruments may influence competitive dynamics, risk management, capital structure and future discussions on regulatory counterparts, sustainability and operational continuity.
