Law No. 15,357/2026 Authorizes Pharmacies Within Supermarkets

On March 23, 2026, Law No. 15,357/2026 was enacted, amending Law No. 5,991/1973 to authorize the installation of pharmacies and drugstores within supermarkets.

The new legislation allows this model, providing that the activity may be operated directly by the supermarket, under the same tax registration, or through an agreement with a licensed pharmacy or drugstore, subject to specific requirements, including:

Operation in a physically separate area exclusively dedicated to pharmaceutical activities
Mandatory presence of a licensed pharmacist throughout business hours
Prohibition of displaying medications on regular supermarket shelves, in compliance with applicable health regulations.

The change does not allow the simple placement of medicines on supermarket shelves. Instead, it permits the operation of a fully compliant pharmacy within the establishment, subject to existing regulatory standards.

The law maintains relevant restrictions related to sanitary control and the prevention of self-medication, indicating an effort to balance expanded access with consumer safety.

Overall, the new law can be seen as a restructuring of the pharmaceutical retail model in Brazil, creating new opportunities for the sector.
