08 Oct 2026 Brazil 1 min read

Provisional Measure No. 1,394/2026 introduces a significant shift in Brazil’s betting market by prohibiting fixed-odds betting and establishing a transition regime with immediate consequences for operators and other businesses connected to the sector.

In this Regulatory Update, FAS Advogados examines the key changes introduced by the measure, including the impact on existing authorisations, websites and apps, advertising and sponsorship, payments and wind-down obligations. The publication also outlines the key transition deadlines, the new enforcement structure, the Congressional review process, the judicial challenges already brought before the Brazilian Federal Supreme Court, and the parallel legislative initiative addressing the criminal-law aspects of illegal betting.

The analysis is relevant not only to betting operators, but also to investors, financial and payment institutions, technology companies, digital platforms, media and advertising businesses, sports organisations, sponsors and other companies with exposure to Brazil’s betting ecosystem.
