Brazilian DPA (ANPD) opens public consultation on biometric data processing

The Brazilian Data Protection Authority (ANPD) has launched, this Monday (June 2), a Call for Contributions on the processing of biometric data, a sensitive data category under Brazil’s General Data Protection Law (LGPD). 

This initiative is part of the 2025–2026 Regulatory Agenda and is open for public input until July 2, 2025, via the Participa + Brasil platform. The goal is to support the ANPD’s future regulatory and interpretative actions on the topic. 

The collection of biometric data – such as fingerprints, facial or iris recognition – has been increasingly used in contexts like schools, workplaces, events, borders and financial services. Despite the benefits, the use of such data involves significant risks to privacy and fundamental rights. 

The consultation is structured around five thematic areas: 

  1. Definitions and Principles
  2. Legal Bases for Processing
  3. Facial Recognition and Emerging Technologies
  4. Security, Best Practices and Governance
  5. Data Subject Rights and Protection of Vulnerable Groups 

Active participation from companies, experts and civil society is essential to develop regulation that is effective, proportionate and aligned with international standards.
