Consolidated MTE Ordinance No. 1/2025: Consolidation and Standardization of Digital Labor Obligations

On 18 December 2025, Consolidated Ordinance MTE No. 1, of 17 December 2025, was published in the Federal Official Gazette. This consolidated the rules on the Digital Work and Social Security Card (CTPS) and the main systems and registries used by the Ministry of Labour and Employment into a single Ordinance.

 

Unlike regulations that introduce new requirements, this ordinance has a simpler (and welcome) objective: to bring together, standardize, and clarify existing rules, making consultation easier and reducing doubts in daily application. In summary, the consolidation seeks to:

 

Unlike many normative acts that introduce new rules, Consolidated Ordinance MTE No. 1/2025 focuses primarily on the formal consolidation of existing provisions, seeking to:

  • organize and standardize digital information related to labor obligations;
  • unify, in a single normative text, topics previously scattered across different normative acts;
  • facilitate the application, consultation, and fulfillment of obligations by employers.

 

Among the points covered in the ordinance are:

 

CTPS and its digital issuance – the digital Work Card remains the primary form of registration, with the same effects as the physical version – except in specific situations of social vulnerability.

 

eSocial and mandatory registrations – it is reaffirmed that the General Register of Employed and Unemployed Persons (CAGED) and the Annual Social Information Report (RAIS) must be transmitted exclusively through eSocial, following the model already adopted in recent years.

 

Digital inspection environments – incorporates provisions dealing with the Electronic Labor Domicile (DET) and the Electronic Labor Inspection Book (eLIT), standardizing electronic communication between employers and inspectors.

 

Integrated certificates and databases – the ordinance harmonize the use of information from systems such as Unemployment Insurance, BEM, RAIS, and other statistics, reinforcing interoperability between government platforms.

 

Access profiles and systemic integration – it regulates the granting of administrative access to eSocial, FGTS Digital, DET, and the Electronic Power of Attorney System (SPE).

 

The consolidation does not create new obligations but brings more organization and legal certainty by compiling rules that were previously scattered. For employers, the gain is practical: greater clarity in reading the rules and using the digital systems that are already part of the labor routine.

 

Although it does not introduce new provisions, the new ordinance will come into force on January 2, 2026.
